Welcome to ZapAlerts! These Terms of Service ("Terms") govern your access to and use of the ZapAlerts platform ("Service"), a keyword monitoring service provided by Schneider Enterprises ("we," "us," or "our"). By using the Service, you agree to comply with these Terms. If you do not agree to these Terms, you may not access or use the Service.

By accessing or using ZapAlerts, you agree to be bound by these Terms, including any modifications made to them over time. We reserve the right to modify, update, or discontinue the Service or any part thereof at any time without notice.

8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US, IF ANY, TO USE THE SERVICE.

9. Indemnification
You agree to defend, indemnify, and hold harmless ZapAlerts, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

10. Termination
We reserve the right to terminate or suspend your access to the Service at our sole discretion, without notice or liability, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law
These Terms shall be governed and construed in accordance with the laws of Idaho USA, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts located in Idaho.

12. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable for any reason, the remaining provisions of these Terms will continue to be valid and enforceable.

13. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and ZapAlerts regarding your use of the Service and supersede any prior agreements between you and us on the subject matter.

14. Service may be canceled at any time for any reason.
